1. What Cluejack is

Cluejack is a quiz-show style party trivia game. A host builds boards of categories and clues, puts a board on a TV and runs the game from a phone. Players join from their own phones with a room code and buzz, answer and wager. Cluejack is an independent game and is not affiliated with any television programme.

“Cluejack”, “we” and “us” mean the operator of the service. “You” means a host, a player or a waitlist member, as the context requires.

2. Invite-only beta

Cluejack is in beta and hosting is by invitation only. Joining the waitlist does not guarantee an invitation, and an invitation may be withdrawn. Features may change, break or disappear while we work on the game, and data may occasionally be lost despite our efforts. Keep your own copies of anything you cannot afford to lose; boards can be exported from the app.

There is currently no charge for using Cluejack. If that changes, we will tell hosts in advance and these terms will be updated first.

3. Your account

Hosts sign in with a Google account or a passkey. You must be at least 13 years old to hold an account, and old enough to enter into this agreement where you live, or have a parent or guardian's permission. You are responsible for what happens under your account and for keeping your Google account and passkeys secure. Tell us at once if you think someone else has used your account.

You may link several sign-in methods to one account and remove them from Settings. Only one account per person, please.

4. Your content

Boards, clues, answers, pictures, audio, video and notes you create, upload or import are yours. You keep every right you have in them.

You give us a licence to store, copy, transmit, display and adapt that content only as far as needed to run the service for you and your players: to show clues on the TV and players' phones, to keep your boards and game history, to make backups, and to import files from URLs you give us. The licence ends when the content is deleted, except for copies in routine backups, which expire in the normal course.

You are responsible for having the rights to everything you upload or import. Only upload media you own, that you have permission to use, or that you are otherwise allowed to use in a private game. We do not check what hosts upload, and we may remove content that we believe infringes someone's rights or breaks these terms.

Game records and replay logs saved to your game history are part of your content. We may analyse them to test and balance the game's rules.

5. Acceptable use

Don't use Cluejack to do anything unlawful, and don't:

If you find a security problem, do not exploit it.

6. Hosting players

Players do not sign in and do not agree to anything beyond these terms by joining. As a host you decide who joins your room, and you are responsible for the people you invite, for the display names they use, and for making sure the board is suitable for them. Cluejack is not directed at children under 13; a host who runs a game for a family or a class is responsible for supervising it. The host can kick a player from a game at any time.

The game includes bluffing and side-bet mechanics with names like callouts, bait, sandbagging and cheat sheets. They are game rules about points on a scoreboard. Cluejack does not involve real money or prizes; anything of value hosts choose to wager among themselves is their own arrangement and their own responsibility under local law.

7. Removal of content and accounts

We may remove or disable content, end a game, suspend an account or withdraw an invitation if we reasonably believe these terms have been broken, if the law requires it, or to protect the service and the people using it. Where we can, we will tell you why. Trashed boards are removed permanently after 60 days and media no board uses is removed after 7 days, as described in the Privacy Policy.

8. Our rights

The Cluejack software, design, name and logo belong to us or our licensors. Apart from your own content, you may not copy, modify, reverse-engineer or redistribute the service except as the law allows. Feedback you give us about the game may be used without obligation to you.

9. No warranty

Cluejack is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, availability or accuracy. We do not promise that the service will be uninterrupted, error-free or secure, that content will be preserved, or that it will suit your event. Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent permitted.

10. Limitation of liability

To the fullest extent the law allows, Cluejack and the people who build and run it are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or a spoiled evening, arising from your use of or inability to use the service, even if we were told it might happen. Our total liability for all claims relating to the service is limited to the amount you paid us for it in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Ending the agreement

You can stop using Cluejack at any time. Hosts can delete their account from Settings → Delete account, which immediately and permanently removes their boards, media, game history, replay logs, sessions, linked sign-in methods and account record. We may suspend or end your access as described in section 7. Sections 4 (as to the content licence for anything not yet deleted), 8, 9, 10 and 13 survive termination.

12. Changes

We may change the service at any time during the beta. We may also change these terms; when we do, we will update the date at the top and, for a change that matters, tell hosts in the app before it takes effect. Using Cluejack after a change means you accept the new terms. If you don't, stop using the service and delete your account.

13. Governing law

These terms are governed by the laws of the State of South Dakota, USA, without regard to conflict-of-law rules, and any dispute will be brought in the courts there, unless the consumer-protection law where you live gives you a right you cannot waive. If any part of these terms is found unenforceable, the rest stays in force. These terms and the Privacy Policy are the whole agreement between you and Cluejack about the service.
